Most people are aware that there are a number of ways in which a person can obtain British citizenship. The avenue that most adults use is naturalisation. We at Andrew Williams Solicitors have experience in all types of British Citizenship applications. However, for those of you who intend to naturalise then you will need to meet the following criteria:

  • be over the age of 18;
  • be of good character;
  • intend to live in the UK;
  • passed the knowledge of English and life in the UK tests;
  • have resided in the UK for 5 years or more before making the application;
  • not been outside of the UK for more than 450 days within the 5 year period; OR
  • spent more than 90 days outside the UK in the last 12 months;
  • you must also show you have held ILR for at least 12 months prior to your application or have permanent residency if relying on EU status;
  • you should also note that you could be refused if are accused of breaking any immigration laws while in the UK.

Please also note that different requirements apply if you are a spouse or civil partner of a British Citizen.

    Registration as a child (settled parent)

    If you are a child who was born in the UK and since your birth, one of your parents have become settled in the UK (granted Indefinite Leave to Remain or Permanent Residency) or has become a British Citizen then you can apply to be registered as a British Citizen. If you are applying under this category you must show that you meet all the requirements of the Immigration Rules and provide the relevant evidence.

    Registration as a child (10-year route)

    If wish to apply for British Citizenship as a child who was born in the UK of a different nationality and have resided in the UK for the first 10 years of your life without being absent from the UK for more than 90 days then you can make this application.  You should note however that this application is a discretionary application. If you are applying under this category you must show that you meet all the requirements and provide the relevant evidence.

    Naturalisation (5 years residency)

    This application is to be used by adults over the age of 18 who wish to apply for naturalisation as a British citizen after resided lawfully in the UK for at least 5 years and have held indefinite leave to remain/ permanent residency for the last 12 months.  Please note that this application can only be completed after you have held indefinite leave to remain or permanent residency in the UK for at least 12 months.

    Naturalisation (spouse of British Citizen) 

    This application is to be used by adults over the age of 18 who wish to apply for naturalisation as a British Citizen as the spouse of their British spouse or partner.
