What Is the Financial Requirement and How Do You Meet It?

The financial requirement is the most common reason for family visa refusals. Since April 2024, the minimum income threshold is £29,000 per year for new applicants .

How Can the Sponsor Meet the Financial Requirement?

The sponsor’s income can be counted from:

  • Salaried employment – 6 months of payslips and bank statements showing earnings at or above the threshold
  • Non‑salaried or variable income – Average of the last 6 months (Category B may apply)
  • Self‑employment – 12 months of accounts, tax returns, and bank statements
  • Cash savings – £88,500 held for at least 6 months in the sponsor’s or applicant’s name
  • Pension or non‑employment income
  • A combination of the above

Important: Only the sponsor’s income counts for initial applications from outside the UK . The applicant’s overseas income cannot be used.

What If the Sponsor Is Returning to the UK from Abroad?

If the sponsor is a British citizen or settled person who has been living abroad and is returning to the UK with their partner, they can use a Category B approach. They must show:

  • A confirmed UK job offer paying at least £29,000 per year, starting within 3 months of return; and
  • That in the 12 months before application, their total income (from overseas employment, etc.) was at least £29,000 .

What Is the Accommodation Requirement and What Evidence Do You Need?

The sponsor must prove that there will be adequate accommodation for the applicant and any dependants when they arrive in the UK.

What Counts as Adequate Accommodation?

  • The property must be owned or legally occupied by the sponsor (or a family member with permission)
  • It must not be overcrowded under the Housing Act 1985
  • It must be available exclusively to the family (i.e., you will have your own living space)

What Evidence Should the Sponsor Provide?

How Does the Sponsor Prove the Relationship Is Genuine?

The sponsor must provide evidence that the relationship is genuine and subsisting. This is not just about being married—you must show that you have a real, ongoing relationship and intend to live together permanently .

Key Evidence from the Sponsor

  • Marriage or civil partnership certificate
  • Evidence of cohabitation (if you have lived together) – joint bank statements, tenancy agreements, utility bills
  • Evidence of contact during periods apart – call logs, WhatsApp messages, emails, travel itineraries, boarding passes
  • Photographs together over time (curated, not dozens of selfies)
  • Letters from family or friends (optional, but can support)
  • Financial interdependence – joint accounts, money transfers

The sponsor should also write a personal statement explaining how the relationship developed, how you have maintained it, and your plans for living together in the UK .

Does the Sponsor Need to Sign a Maintenance Undertaking?

For most partner visas, there is no formal maintenance undertaking because the financial requirement already proves you can support yourselves. However, if the sponsor receives certain disability or carer benefits, the financial requirement is waived and replaced with an “adequate maintenance” test. In such cases, the sponsor must sign a maintenance undertaking (Form SU07) confirming they will be responsible for the applicant and will not claim public funds .

The maintenance undertaking is a legally binding document. If the applicant claims public funds during the 5‑year qualifying period, the UK government can recover those costs from the sponsor .
