Skilled Worker Visa Delays and an Approaching Job Start Date

A delayed Skilled Worker decision with a start date approaching is difficult for both the applicant and the sponsor. There are recognised ways of raising a delay with UKVI, and there are practical steps a sponsor can take about the start date. None of them can compel a decision by a particular date; timescales and outcomes rest with UKVI.

Published service standards

UKVI publishes the timescales it aims to work to for Skilled Worker applications made inside and outside the UK. A wait only becomes "out of standard" by reference to those published aims, which is the starting point for any escalation.

Published processing times change. Check the current published processing times on GOV.UK before relying on them.

Raising a delay

Where an application is outside the published standard, the applicant can contact UKVI through the published channels and ask for an update. Escalation may also be possible through a Member of Parliament. Realistically, these routes prompt a review of the file; they do not produce a decision on demand.

Sponsor-side steps

A sponsor can consider deferring the start date, check the reporting duties that arise from a change to the role or start date, and keep a written record of the position. Sponsor duties continue to apply throughout.

What to avoid without advice

Travelling, cancelling the application, submitting a second application, or amending the Certificate of Sponsorship without advice can all cause problems that are harder to correct later.
