UK Spouse Visa Refusals: Common Reasons and Next Steps

A spouse visa refusal is unsettling, but it is not necessarily the end of the route. Most refusals turn on evidence rather than on the relationship itself: a financial requirement that has not been evidenced in the format the Immigration Rules require, gaps in the documented relationship history, or documents that do not match what was declared. This article sets out the reasons we see most often, and what usually needs to change before a fresh application or a challenge. Every case is assessed on its own facts and evidence.

Start with the refusal notice

The refusal notice identifies the paragraphs of the Immigration Rules relied on, and states whether you have a right of appeal, a right to administrative review, or neither. That wording sets the time limits that follow, so it should be read carefully before anything else is decided.

Financial requirement evidence

The financial requirement is not only about income level; it is about evidencing income in the specified format. Refusals commonly follow missing payslips, bank statements that do not corroborate the payslips, employer letters that omit required detail, or self-employment evidence that does not align with the accounting period relied on.

Genuine and subsisting relationship

Where a relationship is questioned, the issue is usually documentary coverage over time — cohabitation evidence, correspondence at a shared address, evidence of contact during periods apart, and consistency between the accounts given by each partner.

Accommodation and English language

Refusals also arise on adequate accommodation evidence and on English language evidence, particularly where a test certificate is from a provider or centre not approved for the route at the date of the test.

Suitability and immigration history

Previous overstaying, a prior refusal, or a discrepancy between what has been declared on different applications can lead to refusal on suitability grounds. These points need to be addressed openly and with supporting explanation.

Your options after a refusal

Depending on the notice, the options are usually an appeal to the First-tier Tribunal, administrative review, or a fresh application with corrected evidence. Each carries different deadlines, costs and evidential requirements. Choosing between them is a legal judgment on the facts of the individual case.

How our solicitors approach a refusal

A solicitor reads the refusal notice, reviews the evidence that was submitted against the requirements relied on, identifies what is missing or unclear, and advises on the merits of each available option. Every piece of advice and every submission is prepared and approved by a solicitor.
