UK Spouse Visa Rules: What Applicants Need to Check

Spouse visa requirements are set out in the Immigration Rules and change from time to time. The rules that matter are those in force on the date the application is made, so the first step is always to confirm the current position.

Relationship requirement

The relationship must be genuine and subsisting, and the couple must intend to live together permanently in the UK. Evidence is expected to cover the history of the relationship rather than a single point in time.

Financial requirement

The financial requirement can be met from employment, self-employment, savings, certain benefits, or a permitted combination. Each source has its own specified evidence and its own qualifying period, and the format of the evidence is as important as the amount.

Accommodation

Applicants must show adequate accommodation that is owned or occupied exclusively by the family, without overcrowding as defined in the rules.

English language

An applicant must meet the English language requirement, usually by an approved test at the required level, unless an exemption applies. The test provider and centre must be approved for the route at the date of the test.

Suitability and history

Previous overstaying, refusals, or inconsistencies between applications can lead to refusal on suitability grounds. These need to be addressed openly with supporting explanation.
