Visitor visa vs family routes

Visitor visa or spouse visa: visiting versus joining a partner

The right route depends on the real purpose of the trip—not simply whether a spouse lives in the UK.

A temporary visit or living together

A genuine temporary visit to a spouse or partner can fall within the visitor route if its requirements are met. Moving to live with a partner normally requires an appropriate family or other residence route, with separate eligibility requirements.

Do not use visiting as a settlement plan

A visitor must intend to leave. Entering as a visitor while actually intending to remain permanently can conflict with the visitor requirements and may create credibility or suitability problems.

Check marriage and switching rules separately

Plans to marry or give notice require consideration of the appropriate route; a Marriage Visitor visa is different from a family visa. Visitors cannot normally switch into the partner route from within the UK, although limited exceptions require individual advice. Do not assume a relationship automatically creates permission to remain.

Common mistakes

  • Calling a planned permanent move a family visit.
  • Assuming marriage automatically allows a visitor to stay or switch routes.

Evidence to consider

These are examples to consider where relevant, not a mandatory checklist or a guarantee that requirements are met.

  • A truthful explanation of whether the stay is temporary or a move.
  • Relevant relationship circumstances and advice on the appropriate route.
